As a parent, your natural instinct is to protect and love your child or children.
You may have every security precaution known to man in your home to protect your loved ones.
You might even have a nanny cam in your home.
Do you remember the Michigan family that had a nanny cam in their home and they caught a 'ghost' scratching their daughter?
While you may not be catching ghosts on your nanny cam, you might still want one out of precaution.
Are Hidden Nanny Cams Legal in Michigan?
Yes! It is legal to install hidden nanny cams in all 50 states without needing consent to videotape the nanny.
Michigan Penal Code 750.539d says that you can:
"Install, place, or use [nanny cam] in any private place, without the consent of the person or persons entitled to privacy in that place, any device for observing, recording, transmitting, photographing or eavesdropping upon the sounds or events in that place."
Now, before you go and install your new nanny cam, there are 13 states that do not allow you to put the cameras in any private areas.
Michigan is one of those 13 states. The others are:
- Alabama
- Arkansas
- California
- Delaware
- Georgia
- Hawaii
- Kansas
- Maine
- Minnesota
- New Hampshire
- South Dakota
- Utah
What is considered a private place?
According to The Reeves Law Group,
"A private place is one where a person may reasonably expect to be safe from unauthorized surveillance. This means you can't record in clearly private areas of your home, such as the bathroom or a live-in nanny's bedroom."
So before installing a nanny cam, ensure you are not placing it in any private areas.
